This Legal Notice governs all interactions with the Wellsaac online store, operated through our Shopify-powered website ("the Site"). By browsing, accessing, or purchasing from the Site, you agree to be bound by the policies set out below.

These policies are drafted in accordance with South African law, including the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), and the Protection of Personal Information Act 4 of 2013 ("POPIA").

Platform Disclosure: Shopify

Wellsaac operates its online store using Shopify Inc., a third-party e-commerce platform. Shopify processes certain data on our behalf as a technical operator.

By using this Site, you acknowledge that Shopify powers the store infrastructure, including checkout and payment processing; that your data may be processed by Shopify in accordance with their Privacy Policy (shopify.com/legal/privacy); that Wellsaac remains the responsible party under POPIA; and that credit card details are handled exclusively by Shopify's PCI-DSS-compliant payment systems — Wellsaac does not store them directly.

Terms of Service

Acceptance: Access to and use of the Site constitutes your unconditional acceptance of these Terms. If you do not agree, you must immediately cease using the Site.

Eligibility: You must be 18 years of age or older to transact on this Site. Where a minor uses the Site with parental or guardian consent, the responsible adult assumes full legal accountability.

Accuracy of Information: We make reasonable efforts to ensure product descriptions, pricing, and availability are accurate. Errors may occur, and we reserve the right to correct inaccuracies or cancel orders placed on the basis of incorrect information, subject to your rights under the CPA.

Pricing & Modifications: All prices are in South African Rand (ZAR) inclusive of VAT where applicable and are subject to change without notice. We reserve the right to modify, discontinue, or limit any product or service at any time.

Prohibited Conduct: You agree not to use the Site for any unlawful purpose, including violating applicable laws, infringing intellectual property rights, transmitting malware or viruses, engaging in fraud, scraping personal data, or reproducing or reselling any part of the Site without written permission. Breach of these provisions may result in immediate termination of your access.

Privacy Policy

Information We Collect: We collect Order Information (name, billing and shipping address, email, phone number, and payment details processed by Shopify) and Device Information (IP address, browser type, time zone, pages visited, and cookies).

How We Use It: Your information is used to process and fulfil orders, detect fraud, send transactional communications, and — where you have consented — send marketing communications.

Sharing: We do not sell your personal information. We share it only with Shopify (for store operations), courier partners (for delivery), and Google Analytics (for anonymised site analytics). Information may also be disclosed where required by law.

All content on this Site including logos, brand assets, photography, copy, and design — is the intellectual property of Wellsaac or its licensors. No portion may be reproduced, distributed, or commercially exploited without prior written consent.

The Site may contain links to external websites or optional third-party tools. Wellsaac does not endorse or control any third-party content and accepts no responsibility for it. Your use of any third-party service is at your own risk and subject to that party's own terms.

Governing Law & Dispute Resolution

These policies are governed by the laws of the Republic of South Africa. Disputes shall be subject to the jurisdiction of the South African courts, without prejudice to your rights under the CPA, including the right to approach the National Consumer Commission or a relevant consumer court.

Wellsaac reserves the right to update this Legal Notice at any time. Changes are effective immediately upon posting. Continued use of the Site following any amendment constitutes acceptance of the revised terms.
